My deposit check was cashed in May 2012 so that materials could be purchased. Materials were never delivered and each time we would receive any sort of response it was always one excuse after another such as; waiting on my best crew to become available, it’s too hot for my crew to begin working; we are finishing up this other job then we’ll be able to start on yours. Finally after 6 months and a demand letter, we wound up in small claims court seeking a refund of our deposit. We were awarded a full refund that was to be paid to the court within 30 days, which would have been December 2012. It’s now May 2013, a year since they cashed our deposit and we’ve not received the refund, no materials were ever delivered and obviously no work was ever completed.
