Ms. Kam released the Earnest Money deposit before my loan papers were approved. Because the appraisal came in lower than the offer, I was required to either increase the down payment by $ 50,000, or have the buyers and Wells Bennet keep the $ 26,000 Earnest Money deposit. Had the deposit not been released I could have continued to negotiate with the buyer or the bank.
The early release of the deposit was a complete error on Kam’s and WB’s side and very unprofessional. If I failed to complete the transaction, and the buyer kept the funds, I would have to sue WB to get the money back since the buyer was not at fault. The lender was shocked, and it took every cash dollar I had, and the liquidating of investments, to increase the downpayment.
The result is that because of a broker error, my bank account was zero, I lost money on the liqudated investments, and I had to pay a price greater than the appraisal. Still, Kam and WB get paid fully.
While this was the biggest error, it was not the only error. During negotiations Ms. Kam, the experienced professional, suggested I negotiate a reduction for repairs. The Selling broker’s response was for me to cover some closing cost and Ms. Kam, the experienced professional, counselled that this was a good deal. When the transaction was complete, and I was now only dealing with the lender, I learned that the net effect of Ms. Kam’s negotiations was $ 0, but the effective result was for me to have to come up with additional cash of $ 5,000.
By the way, who in this negotiation know how much cash I had and my investments? The broker. In hindsight I would never, ever, ever, let a broker know how much money I had or the funds available.
Do you really think I could recommend this person or brokerage? Never.
