San Diego Grand Jury

I wrote to the Grand Jury twice regarding my son’s case. The jury was tainted and the judge didn’t care. The trial should have been declared a mistrial or a new jury selected. The DA buried evidence from the jury that was given in the prelims by witnesses, The witnesses statements could have cleared my son! The DA also used fixed photo lineups fixed by the Santee CA Sheriff’s detectives. All guys in the photo’s had on white shirts or gray shirts and my son had on a red shirt. He put a flag up for his witnesses to be able to point him out. After reporting the problems with the District Attorney Clay Biddle to the DA’s office and the Grand Jury, I expected to get some results. The jury found my son guilty? He was sentenced to 9 years in prison for crimes he didn’t commit. The Grand jury did not respond to my complaint against the District Attorney who prosecuted my son, nor the San Diego District Attorneys Office. The DA’s office refuse to re-​open the case, and the Sheriff’s refuse to take responsibility for a false arrest! The two co-​defendants were responsible for the incidents that happened but were released from jail. They tried to tell the court that my son had nothing to do with it but the DA conspired with the two detectives to get my son put in prison. My son is very innocent! He was not even in the town where and when that incident happened. Our witnesses were vetted out or released from testifying. So, on a tainted jury, how does that give justice to my son? He had an unfair trial. The Grand Jury needs to step up and take a good look at the corruption within the District Attorneys Office. «Representing the citizens of San Diego County by investigating, evaluating, and reporting on the actions of local governments and special districts.»
The Vision Statement is equally as encompassing:
«Enhancing our community by creating a collaborative, cooperative environment leading to improved performance of public agencies within San Diego County» In other words-​the Grand Jury is the purest form of government-​not (hopefully) subject to political manipulations or governmental intrusion.
.The origin of the grand jury has been traced to the Norman Conquest of England in 1066. In the United States, the Massachusetts Bay Colony impaneled the first grand jury in 1635 and by the end of the colonial period the grand jury had become an indispensable adjunct of government. The grand juries were the able to propose new laws, protest against abuses in government, and wielded tremendous authority in their power to determine who should and should not face trial.
San Diego County’s first grand jury was impaneled in 1850. The grand jury in California is unusual in that its duties include investigation of county government and county government officials– as provided by statutes passed in 1880. This is what I am counting on to allow me some aspect of justice in a case where a decision was made to prosecute me based on a pack of lies. Only a few other states provide for grand jury investigation of county government beyond alleged misconduct of public officials. Thank God San Diego allows investigation of authorities who abuse their civic authorities and promote misconduct in office.
Today, grand jurors are officially «officers of the court» They work together as an independent body representing all the people of the county. They have the power to subpoena and may inquire also into written complaints brought to it by the public. Complaints are accepted in writing on a form available in the Grand Jury office but only causes of action occurring within San Diego county are eligible for review.
My experiences with the Grand Jury system is that I have applied twice to be a member. Once a wonderful Judge named Napoleon Jones sponsored me but I ended up getting a full-​time job and couldn’t participate. Recently I applied, but missed the deadline; I would be interested in trying again. This year’s panel wrote a report on the homeless situation in San Diego and the need for a shelter open year-​round. Another blistering release: a scathing denunciation of «financial irregularities» at the San Diego Unified School District!
This Grand Jury is awesome! I hope next year’s panel is as fearless as this years! Because I already have some interesting cases all set for them to review! THE NOBLEST MOTIVE IS THAT OF THE PUBLIC GOOD!
