I purchased the item in question on October 28th, 2007 from . Before I made my purchase, I made sure to read reviews about the website in which I noticed that some customers noted how they received the wrong cell phones. Being aware of this, I decided to use the website’s chat system in order to confirm the item was indeed what I wanted and that there would be no mishaps or errors in communication. During the chat with the customer service representative, I explicitly asked whether the cell phone in question was the black and green and new, in box. The first message sent is not recorded but I sent the URL for the webpage and asked the two questions. I had the chat session sent to my email, which I have posted below. The cell phone received was not only yellow but not new, in box. The box for the phone was black and green while the phone inside was the yellow phone, showing that the phone is indeed neither the correct color or new. In addition, this gives evidence that this online retailer is deliberately attempting to manipulate their customers. A week after I ordered the phone, I called the company asking about the status of my phone because I did not receive it yet. I was told that«UPS lost it» and that they were sending me another phone immediately. This was also another lie because once I received the UPS tracking number, the status of my package remained as «Billing Information Received» from October 28th until a week after I spoke with the company on the phone. Thus, the company was attempting to pass blame onto UPS instead of themselves for the delay in shipping. During these calls to the company, they hung up on me multiple times, forcing me to call three or four times in order to receive my tracking number as well as answers to my inquiries. I eventually received the cell phone on November 26th. As expected, I was very upset so my girlfriend called the company for me the next day. My girlfriend called the company the morning after on November 27th. During this call, she outlined everything we discussed prior, pointing out that the phone was not only the wrong color, but branded from an Italian cell phone provider(TIM) and possibly refurbished due to being in a heavily worn box that had the display of the black and green phone instead. She asked for a refund, citing their refund policy found at which states that a refund is available up to 14 days after the day of purchase. They used this 14 day period against us saying that it was not within 14 days however the delay in shipping was on their part, causing the package to be delayed a minimum of that 14 day period. In my own opinion, I believe that this was an intentional ploy by the company because they knew they were sending a fraudulent product. In addition to this, the man being spoken to on the phone about this matter displayed deliberate discrimination and sexism towards my girlfriend. When discussing their refund policy, the customer service representative said, «Sweety, do you know how to use the internet?» to my 22-year old girlfriend who is highly proficient at anything computer oriented. This deliberate insult was yet another showing of the lack of moral character that this company contains. After this insult, the representative proceeded to hang up on my girlfriend, like they did to me many times prior. The webpage used to order the cell phone, the phone in the picture is black and green as well as unbranded. In addition, on November 27th, I went into the company’s chat room service again and explicitly asked them if all their phones are unbranded as well as new in unopened boxes. The company answered«yes» to both of these questions, yet another lie on their behalf. After the company refused to help me in this matter and hung up, leaving me no further option, I contacted Visa about this matter. Do NOT buy from these people. They are not poor businessmen, they are CRIMINALS and I STILL don’t have this resolved 6 months later!
